Will the world survive?

 2011 No other generation has heard so much talk about the end of the world. Many fear that the world will end in a nuclear holocaust. Others think that pollution may destroy the world. Still others worry that economic chaos will set masses of humanity against on another.  Could the world really end?  If it did, what would it mean? Has a world ever ended before?

 A WORLD ENDS – ANOTHER REPLACES IT

 Yes, a world did end. Consider the world that became very wicked in the days of Noah. The Bible explains: “The world of that time suffered destruction when it was deluged with water.”  The Bible also says: :”God did not hold back from punishing an ancient world, but kept Noah, a preacher of righteousness, safe with sever others when he brought a deluge upon a world of ungodly people.”  2 PETER 2:5; 3:6.

 Note that the end of that world meant and what it did not mean. It did not mean the end of humankind. Noah and his family survived the global Flood. So did the planet Earth and the beautiful starry heavens. It was “a world of ungodly people” that perished a wicked system of things.

 Eventually, as Noah’s offspring increased, another world developed. That second world, or system of things, has existed down to our day. Its history has been filled with war, crime, and violence. What will happen to this world? Will it survive?

 THE FUTURE OF THIS WORLD

 After saying the world in Noah’s day suffered destruction, the Bible account continues: “By the same word the heavens and earth that are now stored up for fire.” 2 PETER 3:7.  Indeed, as another Bible writer explains: “The world, the one existing today, is passing away.”  1 JOHN 2:17.

The Bible does not mean that the literal earth or the starry heavens will pass away, even as these did not pass away in Noah’s day. PSALM 104:5.  Rather, this world, with its “heavens,” or governmental rules under the influence of Satan, and its “earth,” or human society, will be destroyed as if by fire. JOHN 14:30; CORINTHIANS 4:4.  This world or system of things will perish just as surely as did the world before the Flood. Even JESUS CHRIST spoke about the situation in “the days of Noah” as an example of what would happen just prior to the end of this world. MATTHEW 24:37-39.

 Significantly, when JESUS spoke of the days of Noah, it was in answer to his apostles’ questions:  “What shall be the sign of thy coming, and of the end of the world?  MATTHEW 24:3, KING JAMES VERSION.  JESUS’ followers knew that his world would end. Did this prospect frighten them?

 On the contrary, when JESUS described events that would occur prior to the world’s end, He encouraged them to rejoice ‘because their deliverance was getting near.’ LUKE 21:28.  Yes, deliverance from Satan and his wicked system of things into a peaceful new world!  2 PETER 3:13.

But when will this world end? What “sign” did JESUS give of this “coming, and of the end of the world”?

 THE SIGN

 The Greek word here translate “coming” IS PA-ROU-SI’ A, and it means “PRESENCE,” that is, actually being on hand. So when “the sign” is seen, it would not mean CHRIST was soon to come but the HE had already returned and was present. It would mean that HE had begun ruling invisibly as a heavenly king and the HE would soon bring an end to his enemies. REVELATION 12:7-12; PSALM 110:1, 2.

JESUS did not give just one event as “the sign.”  HE described many world events and situations. All of these would take place during the time that Bible writers called “the last days.” 2 TIMOTHY 3:1-4; 2 PETER 3:3, 4. Consider some of these things that JESUS foretold would mark “the last days.”

 “NATION WILL RISE AGAINST NATIONANDKINGDOM AGAINST KINGDOM.”  MATTHEW 24:7.  Following World War 1 came perhaps the greatest famine in all history. Terrible famine also followed World War 11. A scourge of malnutrition affects up to one fifth of earth’s population, killing over 14 million children every year. Truly, there have been “food shortages”!

 ”THERE WILL BE GREAT EARTHQUAKES.”  LUKE 21:11.  On the average, about ten times as may have died each year from earthquakes since 1914 as in previous centuries. Consider only a few mayor ones: 1920 –China, 200,-000 killed; 1923 – Japan, some 140,000 died or disappeared; 1938 –Turkey, 32,700 fatalities; 1970 –Peru, 66,800 killed; and 1976 –China, about 240,000 and according to some sources, 8000,000 casualties. Surely, “great earthquakes”!

 “INONEPLACEAFTER OTHER PESTILENCES.”  LUKE 21:11.  Right after World War 1, some 21 million people died of the Spanish flu, Science Digest reported: “In all history there had been no sterner, swifter visitation of death.:”  Since then, heart disease, cancer, AIDS, and many other plagues have killed hundreds of millions.

 “INCREASING OF LAWLESSNESS.”  MATTHEW 24:12.  Our world since 1914 has become known as one of crime and violence. In many places no one feels safe on the streets even during the daytime. At night people stay in their homes behind locked and barricaded doors. Afraid to go outside.

Many other things were foretold to occur during the last days, and all of these also are being fulfilled.  This means the end of the world is near. But, happily, there will be survivors. After saying “the world is passing away,” the Bible promises: “He that does the will of GOD remains forever.”  JOHN 2:17.

 So we need to learn GOD’S Will and do it. Then we can survive this world’s end to enjoy eternally the blessings of GOD’S new world. The Bible promises that at that time: “GOD … will wipe out every tear from people’s eyes, and death will be no more, neither will mourning nor outcry nor pain be anymore.”  REVELATION 21:3-4.    With my gratitude to Watch Tower Bible, www.watchtower.org.

¿Podrá sobrevivir este mundo?

2011 Ninguna otra generación ha oído hablar tanto sobre el fin del mundo. Muchos temen que el mundo terminará en un holocausto nuclear. Otros piensan que la contaminación puede destruir el mundo. Hay quienes se preocupan de que el caos económico pondrá masas de la humanidad unos contra otros. ¿Podría realmente terminarse el mundo? Si así fuera, ¿qué significaría? ¿Ha el mundo terminado antes?

Un mundo se acaba – OTRO lo reemplaza

Sí, un mundo se había acabado antes. Considerar el mundo que llegó a ser muy malo en los días de Noé. La Biblia explica: “El mundo de aquel tiempo sufrió destrucción cuando fue anegado en agua.” La Biblia también dice: “Dios no se contuvo de castigar a un mundo antiguo, pero mantuvo a Noé, pregonero de justicia, seguro con romper otros, cuando trajo un diluvio sobre un mundo de gente impía corrupta” 2 Pedro 2:5;. 3:6.

Tenga en cuenta que el fin del mundo, que significó y lo que no significa. No significa el fin de la humanidad. Noé y su familia sobrevivieron al diluvio universal. Lo mismo hizo el planeta Tierra y el hermoso cielo estrellado. Se trataba de “un mundo de gente impía” que perecieron con un sistema de cosas inicuo.

Con el tiempo, como descendientes de Noé aumentó, otro mundo fue desarrollado. Como segundo mundo, o sistema de cosas, ha existido hasta nuestros días. Su historia ha estado llena de guerra, el crimen y la violencia. ¿Qué pasará con este mundo? ¿Sobrevivirá?

EL FUTURO DE ESTE MUNDO

Después de decir el mundo en los días de Noé fue destruido, el relato de la Biblia continúa diciendo: “Por la misma palabra los cielos y la tierra que ahora están guardados para el fuego.” 2 Pedro 3:7. De hecho, como explica otro escritor bíblico: “El mundo, el que existe hoy, está por desaparecer.” 1 Juan 2:17.
La Biblia no significa que la Tierra literal ni los cielos estrellados pasarán, aun cuando estas no pasaron en los días de Noé. Salmo 104:5. Por el contrario, este mundo, con sus “cielos”, o normas gubernamentales bajo la influencia de Satanás, y su “tierra”, o la sociedad humana, será destruido, como si por el fuego. Juan 14:30; Corintios 4:4. Este mundo o sistema de cosas se pierde con tanta seguridad como lo hizo el mundo antes del diluvio. Incluso Jesucristo habló de la situación en “los días de Noé” como un ejemplo de lo que ocurriría justo antes del fin de este mundo. Mateo 24:37-39.

Es significativo que, cuando Jesús habló de los días de Noé, fue en respuesta a las preguntas de sus apóstoles: “¿Qué señal habrá de tu venida, y del fin del mundo? Mateo 24:3, versión King James. Los seguidores de Jesús sabían que su mundo se acabaría. ¿Esta posibilidad les asusta?

Por el contrario, cuando Jesús describió sucesos que ocurrirían antes del fin del mundo, les animó a regocijarse ‘porque su liberación se habría acercado. “Lucas 21:28. ¡Sí, la liberación de Satanás y de su inicuo sistema de cosas en un nuevo mundo pacífico! 2 Pedro 3:13.
Pero ¿cuándo terminará este mundo? ¿Qué “señal” dio Jesús de esta “venida y del fin del mundo”?

LA SEÑAL

La palabra griega que aquí se traduce “venida” es un PA-ROU-SI A “, y significa” presencia “, es decir, en realidad está a la mano. Por eso, cuando “la señal” se vea, no significaría que Cristo estaría por venir, sino que ya ha regresado y esta presente. Esto significaría que él ha empezado a gobernar invisiblemente como rey celestial y  que pronto se pondrá fin a sus enemigos. Apocalipsis 12:7-12, Salmo 110:1, 2.
Jesús no dio un solo evento como “la señal”. Describió muchos sucesos y situaciones del mundo. Todas ellas van a tener lugar durante el tiempo que los escritores de la Biblia llaman “los últimos días”, 2 Timoteo 3:1-4; 2 Pedro 3:3, 4. Considere algunas de estas cosas que Jesús predijo que serían indicación de “los últimos días.”

“Se levantará nación contra nación y reino contra reino.” Mateo 24:7. Después de la Segunda Guerra Mundial vino una y tal vez la mayor hambruna de la historia. Hubo hambre terrible después la Segunda Guerra Mundial 11. Un azote de desnutrición afecta hasta a un quinto de la población de la tierra, matando a más de 14 millones de niños cada año. En verdad, ha habido ¡”escasez de alimentos”!

“Habrán grandes terremotos.” Lucas 21:11. En promedio, unas diez veces más podrían haber muertos cada año a causa de terremotos desde 1914, como en siglos anteriores. Considere solo algunos de estos: 1920 – China, 200,000 muertos; 1923 – Japón, unos 140.000 muertos o desaparecidos, 1938 – Turquía, 32.700 muertes, 1970 – Perú, 66.800, y 1976 – China, alrededor de 240.000 y de acuerdo algunas fuentes, 800.000 víctimas. Sin duda, ¡”grandes terremotos”!

“En un lugar tras otras pestes.” Lucas 21:11. Inmediatamente después de la Primera Guerra Mundial 1, unos 21 millones de personas murieron a causa de la gripe española, la Revista Science Digest informó: “En toda la historia no ha habido más severas, más rápidas visitas de la muerte:” Desde entonces, las enfermedades del corazón, cáncer, SIDA, y muchos otros plagas han matado a cientos de millones de personas.

“Aumento del desafuero.” Mateo 24:12. Nuestro mundo desde 1914 se ha dado a conocer como uno de crímenes, delitos y violencia. En muchos lugares nadie se siente seguro en las calles, incluso durante el día. Por la noche la gente permanece en sus casas con las puertas cerradas y aseguradas. Miedo de salir a la calle.
Muchas otras cosas se habían predicho que se producirán durante los últimos días, y todos estos también se están cumpliendo. Esto significa que el fin del mundo está cerca. Pero, felizmente, habrán sobrevivientes. Después de decir “el mundo está finalizando”, la Biblia promete: “El que hace la voluntad de Dios permanece para siempre.” Juan 2:17.

Así que tenemos que aprender la voluntad de Dios y hacerlo. Entonces podemos sobrevivir al fin de este mundo y disfrutar eternamente de las bendiciones del nuevo mundo de Dios. La Biblia promete que en ese momento: “… Dios limpiará toda lágrima de los ojos de la gente, y la muerte no será más, ni luto, ni clamor ni dolor nunca más.” Apocalipsis 21:3-4.

LA APATIA DEL PROFESIONAL EXTRANJERO EN EE.UU.

La Apatía es definida como Trastorno de la afectividad, que se caracteriza por la impasibilidad de ánimo, estado de indiferencia frente a las personas, el medio o los acontecimientos, que trae consigo una alteración en la capacidad de expresión afectiva por parte del individuo frente a toda una serie de estímulos externos e internos.

Partiendo de esta definición, NAFA Tribune News, reportero de autocrítica anual en conexión con nuestra comunidad de profesionales extranjeros en los Estados Unidos, VER: http://www.nafalaw.com/prunpam/tribunews-es.htm se permite expresar nuestra autocrítica para este año 2011, expresando que la actitud asumida por nuestra comunidad de profesionales extranjeros impiden algunos logros, se marchiten y mueran muchas veces “en el tintero” en especial a saber de la Homologación de nuestros hermanos profesionales extranjeros en EE.UU., Ciencias, Cultura y en otras áreas.

La apatía del profesional extranjero es un sentimiento casi uniforme presente en casi todas los/las profesionales que conocemos en Florida, donde seguramente siempre tenemos un pensamiento sobre este tema donde cada persona involucrada solo piensa en un beneficio personal, olvidando así a toda la comunidad profesional de extranjeros en EE.UU.
Este tipo de apatía profesional causa una casi nula participación de la comunidad de profesionales extranjeros en los votos y hasta en las decisiones importantes, ya que si las personas no desean saber absolutamente nada de las políticas y campañas a seguir por ende no van a votar ni participar mucho menos apoyar.

Por esto en la mayoría de casos el profesional que ha homologado en EE.UU., se aísla del resto de la comunidad y comienzan hacer lucrativa ganancias con el privilegio obtenido con la homologación. Luego lo peor de todo es que las mismas personas profesionales extranjeros que se quejan son las mismas personas que no votaron, no apoyaron las que simplemente no les importo hacer uso de su derecho a pedir igualdad y reciprocidad profesional apoyando a dirigentes de NAFA ASSOCIATION con iniciativas efectivas.

En específico traemos a colación dos importantes temas que fueron lanzados por NAFA ASSOCIATION comenzando enero 2011 a favor de nuestros colegas extranjeros en EE.UU. cuales temas fueron recibíos con total apatía por nuestra comunidad:
Primero: La iniciativa de promover la Homologación de títulos de educación universitaria en Estados Unidos convenio firmado por casi todo el hemisferio en el año 1974. VER:

Segundo: La iniciativa de promover la Reciprocidad entre abogados extranjeros y abogados locales en Estados Unidos; para lo cual solicitamos vuestro apoyo lanzando una campaña de “emails” al ABA, American Bar Association y su delegada por Florida.

Quizás puede ser mejor olvidarnos de todo y tratemos de olvidarnos de este pensamiento sobre la homologación, la cual es una meta inalcanzable, seguramente va a ser algo muy difícil de lograr, pero si en algún momento somos capaz de llegar a un quórum podremos seleccionar un mejor futuro. The death of the enemies is necessary, the question is whether is it possible? We define these enemies as rapists criminals against humanity, beginning with violators of basic rights of humanity, these rigths are food, shelter, education. Fidel Castro Ruz, is a blatant criminal rapist of these basic rights. For over 50 years, in addition to slaughter in their firing squad, he has dictated to its Cuban citizens, what and when to eat, where and how to live, and where to study. Chavez is one of these criminal offenders, but he is a “clone” of Castro.
From a Religious point of view, the death of these rapists mass criminals, is not the final solution and we can not escape them. In a way, we always are pursued by a common enemy is death. The Bible, I Corinthians 15, 26, shows us that death is an enemy which none of us can escape it or defeat it either, and we’ve all seen how this has taken the life of someone close. But God is more powerful than death. He is our loving Rescuer. In fact, He has proved that He can and has had defeat it, and also promises to end this once and for all.

From the legal point of view, the death penalty, capital punishment or execution is to kill or murder a convicted by the state as punishment for an offense specified in the legislation, the crimes for which this penalty is applied often referred to as capital crimes, crimes against humanity. In the book, Critical Legal Review the 83 Laws of Toro, the year 1827, the author Don Sancho De Llamas Molina, writes that death to the criminal violator is death to an enemy just and necessary, this law in a particular case does not prevent non-prescriptive as unfair, allowing or giving the right to exercise an act prohibited by the law of nature …

From the social point of view, the death of criminals and political dissidents has been used by some societies at a time in its history, both to punish crime and to suppress political dissent. The death penalty has been abolished and penalized in almost all European countries (except Belarus), and most for Oceania (Australia, New Zealand and East Timor). Most Latin American countries have abolished the death penalty, while in countries like the United States, Guatemala and most Caribbean states are still applied. In Asia, the death penalty is allowed in democracies such as Japan and India. In Africa, still used in Botswana and Zambia.

From the standpoint of the victim, supporters of it believe that its implementation reduces crime, prevents their recurrence and is a form of punishment for murder and criminal acts. Critics argue that it reduces crime to a greater extent than life imprisonment, are worse than the crime, are burnt offerings and is de facto discrimination against minorities and the poor who may not have sufficient resources in the legal system.

From my point of view, these abusers of humanity are identified since 1950 under the name of the Holocaust. what is known technically as well, following the terminology of the Nazi state itself, such as Final Solution (German Endlösung) of the Jewish question, that is, the attempt to totally annihilate the Jewish population in Europe with the murder of more than 6 million people by way from starvation, forced labor to poison gas. Fidel Castro Ruz, and its clone Chavez and others, fall under my definition, more detailed in my lawsuit against the Communist power in Cuba (SEE http://www.nafalaw.com/es/lawsuit.pdf).   ATTN. DR.  La muerte de los enemigos es necesaria, la pregunta es si ¿es posible?  Definimos estos enemigos como los violadores criminales contra la humanidad, comenzando violadores de los derechos básicos de la humanidad, estos son, alimento, techo, educación. Fidel Castro Ruz, en un violador criminal flagrante de estos derechos básicos.  Por mas de 50 años, además de masacrar en sus paredón de fusilamiento, ha dictado a sus ciudadanos, que y cuando comer, donde y como residir, donde y que estudiar.  Chávez es uno de estos violadores criminales, pero este es una “clonación” de Castro.

 Desde un punto de vista religioso, la muerte de estos violadores criminales en masa, no es la solución definitiva y no podemos escapar de estos.  En cierta forma, a todos nosotros siempre nos persigue un enemigo común como es la muerte. La Biblia, en Corintios 15; 26, nos muestra que la muerte es un enemigo del cual, ninguno de nosotros puede escapar de ella ni vencerla tampoco, y todos hemos visto como esta le ha quitado la vida a alguien cercano.  Pero Dios es mucho más poderoso que la muerte. El es nuestro amoroso Rescatador. De hecho, ya ha demostrado que si puede derrotarla y, además promete acabar con esta de una vez por todas.

 Desde el punto de vista legal, la pena de muerte, pena capital o ejecución consiste en provocar la muerte o asesinar a un condenado por parte del Estado, como castigo por un delito establecido en la legislación; los delitos por los cuales se aplica esta sanción suelen denominarse delitos capitales, delitos contra la humanidad.  En el Libro, Comentario Critico Jurídico a las 83 Leyes de Toro, año 1827; el autor Don Sancho De Llamas Molina, escribe que, la muerte al enemigo violador es justa y necesaria, esta ley en un caso particular y no preceptiva no impide que fuera injusta, permitiendo o dando facultad para ejercer un acto prohibido por la ley natural… 

 Desde el punto de vista social, la muerte de criminales y disidentes políticos ha sido empleada por algunas sociedades en un momento de su historia, tanto para castigar el crimen como para suprimir la disensión política. La pena de muerte ha sido abolida y penalizada en casi todos los países europeos (excepto Bielorrusia), y la mayoría de los correspondientes a Oceanía (como Australia, Nueva Zelanda y Timor Oriental). La mayoría de países latinoamericanos han abolido la pena de muerte, mientras que en países como los Estados Unidos de América, Guatemala y la mayoría de los estados del Caribe aun siguen siendo aplicadas. En Asia la pena de muerte está permitida en democracias como Japón e India. En África, aún se usa en Botswana y Zambia.

Desde el punto de vista de la victima, los simpatizantes de la misma opinan que su realización reduce el delito, previene su repetición y es una forma de castigo para el asesinato. Los detractores argumentan que no reduce el crimen en mayor medida que la cadena perpetua; son peores que el delito, son holocausticas y es una discriminación de hecho contra las minorías y los pobres que puedan no tener recursos suficientes en el sistema legal.

 Desde mi punto de vista, estos violadores de la humanidad son identificados desde el 1950 con el nombre de Holocausto. a lo que técnicamente también se conoce, siguiendo la propia terminología del Estado nazi, como Solución Final (en alemán, Endlösung) de la cuestión judía, esto es, el intento de aniquilar totalmente a la población judía de Europa con el asesinato de mas de 6 millones de personas por medios desde hambre, trabajo forzado hasta gas venenoso.  Fidel Castro Ruz, el clone Chávez y otros, entran dentro de mi definición, mas detallada en mi demanda judicial contra el poder comunista en Cuba (VER: http://www.nafalaw.com/es/lawsuit.pdf).  ATTN. The NAFA’S Knights of the Round Table is Humphrey Humberto Pachecker’s arm to protest against civil and human rights violations, injustices, legal and judicial activism against citizens in theUnited States.  The core of its name’s interpretation is that there is no head at this table.  That is, everyone sitting in it has equal status.  NAFA’s Round Table was best described in an article titled, “Victim again, this time of abuse of judicial discretion.”  By: Humberto Humphrey Pachecker.

 “My question is: Can a federal judge use its powerful position in the magistrate to issue opinions reflecting an extreme judicial philosophy that can be adversarial and damage the civil and constitutional rights of U.S.citizens?
In my old Black’s Law Dictionary, third edition, Lord Coke (1552-1634) is defined judicial discretion as “per legem quid sit discernere justum,” to see which can be just according to the laws of the place. It does not mean a whim dislocated personal whim, which may give rise to any and every act, but this judicial discretion is guided by law, (see that declares the law on some statement of facts and then decide according to law) and therefore make substantial equity and justice. It is a legal discretion to be exercised in discerning the course prescribed by law and not to give effect to the desire of the judge, but to that of the law.
In a more recent definition of 1966, a federal court declares the classical measure for abuse of discretion as, “If it was made without a rational explanation, or an unexplained separation process in place, or rests on a basis not allowed as an individual discrimination against a particular race or group or other considerations which Congress could not have intended to make them relevant. “
Jon Roland of the Constitution Society, in his past  article “Abuse of judicial discretion” dated May 31, 2003 states that the essence of nomocracy (government-based legal system), the rule of law, limiting the discretion officials and to provide a process by which errors or abuse of judicial discretion can be corrected. Some discretion is inevitable, because the law can not anticipate every eventuality or how to decide which law is applicable to a given situation. Which way the law can not provide is supposed to be provided by standard principles of justice and due process, reason and the facts of each case. Ideally, staff should be mutually consistent and interchangeable, making similar decisions in similar cases, so that no one can gain an unfair advantage by choosing the official or exercising undue influence on the official or in the process he works. We rely on officials to exercise discretion as to have the wisdom, justice, and the ability to avoid a government that is arbitrary, insolent, discriminatory, prejudiced, arbitrary and corrupt.
Within the public sector, discretion can be exercised by officials legislative, executive, or judicial. Within the private sector, discretion can be exercised by private officials, such as agents, managers or corporate officers who are in principle under the supervision of the courts. The focus here is on judicial discretion, and abuse it. Not discuss each area of ​​judicial discretion.”
The first major check on the discretion of judges was the jury. A judge holding office over the course of multiple cases, and selected for appointment or election, is susceptible to undue influence. A jury, chosen by lot, or portion, for a single case, just before the case is less likely to be corrupted, and having multiple jurors render verdicts collectively providing a check on each other. What what the jury may be lacking in knowledge of the law is compensated by their connection to regular non-legal environment in which most people under the law should work.
In the courts trying to save time and money by not using a jury, such as family courts in some states, complaints about abuse of judicial discretion led to calls for juries to decide questions of custody, visitation of,  child support, and distribution of marital property.
Judges who impose lenient sentences to prevent prison overcrowding and early release of violent offenders, often leads to demands for mandatory minimum sentences or sentencing guidelines that reduce their discretion to do things like impose reduced sentences to the belief of the defendants who are repentant and are unlikely to commit another offense.
Most of the complaints of abuse of judicial discretion, and calls for more laws to limit, concerns issues of concern to policy or equity. But there is another broad category that refers to constitutional questions of due process and civil rights. This field is too large to discuss adequately in a short article, so only some of the most important classes of judicial discretion is being abused will often be presented in future times.

IMMIGRATION AND THE CIVIL WAR

Dear Honorable Mr. President Barack Obama:  I am at loss to understand why such a worthy issue as a program’s initiative to a solution alleviate and eventually solve our immigration grave problem has been disregarded by the U.S. Authorities to my programs and suggestions I have made to the Federal and U.S. Immigration authorities since the year 2000. My most recent suggestion was sent to your Office at the White House over three months ago to no avail. 

In the year of 1993, I wrote a brief for the University of Miami, School of Law, in care of Professor Ira Kursban, Esquire.  In this brief I predicted that, unless the U.S. Authority would take effective action, there would be another American Civil War, due to the main fact that the “domino’s effect” of the immigration to the U.S. begins on the tip of South America and ends here in the U.S. and is called, basic rights, survival of existence of the human been for his family and other human been.  I predicted that within 20 years, if effective action was not taken, the division of the U.S. People would contribute to the second civil war; Professor Kursban called too wild’s brief and said to me that I was exaggerating!

Today you see that local officials, politicians and law enforcement officers, with the support of part of the U.S. Citizens are challenging the Federal Law and the ruling of an U.S. Courts a rebellion that has not taking precedent since 1860 in this Country.

U.S. History has taught us and we shall remember today that many years ago, in the Presidential election of 1860, the Republican Party, led by Abraham Lincoln, had campaigned against the expansion of slavery beyond the states in which it already existed. The Republican victory in that election resulted in seven Southern states declaring their secession from the Union even before Lincoln took office on March 4, 1861. Both the outgoing administration of President Jams Buchanan and Lincoln’s incoming administration rejected the legality of secession, considering it rebillion.

We do not know how the next civil war in the U.S. would become and when it will to effect, but you now are in the position in history to avoid another war amount its Citizens and the United States.  PS. Happy birthday Mr. President!

Is Gay Marriage’s Issue a Travesty of Law or Civil Rights Violation?

World Book defines marriage as a relationship between a man and a woman who have made a legal agreement to live together.

When a man and a woman marry, they become husband and wife. In a marriage between gay couples how is the husband and wife defined?
In most world Religions marriage is an important religious ceremony. Is gay marriage accepted by any religion? Most couples, man and woman, decide to marry because they love each other and want to spend the rest of their lives together until retirement and death. Is gay marriage contemplated as beneficiary by any Social Security Laws to receive benefits by the spouse and children when the other spouse dies?
Most couples, man and women, who marry plan to have children to raise them together. A husband and wife are legally responsible for the care and protection of their children. Marriage thus serves as the basis of family life. Are gay couples legally capable of having children? Who is legally responsible for the care and protection of the gay couple’s children? How does the gay marriage serve as the basis of a family life?
In the United States, about 50% of all marriages end in divorce. When a man and a woman divorce they must go through laws of equity which provide for division of assets and liabilities, alimony, shared parental responsibility, primary residential care, split custody, child support, etc. If a spouse died there are laws that provide survivor’s benefit to the spouse and children, if qualify even monthly death benefits. Are the Family Civil Courts prepared to deal with gay divorces? Is the Social Security Law ready to deal with gay couple’s disability, family survivors and Medicare?
A man and a woman must follow certain laws when they marry. There are no federal marriage laws each state has its own laws. However, all states laws prohibit close relatives from marrying each other. Laws also forbid a person to marry when he or she is already married to someone else. If some states laws legalize gay marriage would they also legalize marriage between close relatives and bigamy?
Some states permit a couple to marry even if the bride or groom cannot be present at the wedding ceremony. However, someone must serve as a proxy (substitute) for the absent bride or groom, called marriage by a proxy. Can a gay person residing in a state where gay marriage is prohibited be permitted to marry by proxy in another state where gay marriage is allowed?
In some states an unmarried couple living together as husband and wife can be declared by a court “married” after a certain period of time. The time period varies among the states that permit such common law marriage, but it is usually several years. A couple is not required to have a license or a wedding ceremony for a common law marriage. Can gay couples that have establish long term relationships consider themselves to be common law married by the courts?
A man and a woman expect certain things of each other even before they marry. After marriage, some husbands and wives cannot satisfy their partner’s expectations. They may become disappointed and unhappy with each other and have problems with their marriage. Couples with marriage problems mostly end in divorce. Once in court the legal system seeks help from a court’s mediator and/or a train marriage counselor specially where there are children. Is the legal system, the court’s mediator and/or marriage counselor capable of dealing and assisting gay marriage couples especially if there are children?
Almost every society has certain traditional ideas about marriage. For example, most societies expect man and women to marry as well the legal obligations, role and duties of a husband and wife. Has the American Society disregard these traditional legal obligations, role and duties when it comes to gay marriages?
Black’s English Law defines marriage, as distinguished from the agreement to marry and from the act of becoming married, is the civil status of one man and one woman united in law for the discharge to each other and the community of the duties legally incumbent on those whose association is formed on the distinction of sex.
Roman’s Law defines manus marriage as a form of marriage in the early Rome, which was formed in a relationship agreement called “manus” which brought the wife in to the husband’s power, placing the women as to legal rights in the position of a daughter.

In Old English Law, marriage is used in the sense of “maritagium” or the feudal right enjoyed by the Lord or guardian in chivalry of disposing of his ward in marriage.

In Feudal Law, avail of marriage, was the right of marriage, which the lord or guardian in chivalry had of disposing of his infant ward in matrimony. A guardian in socage had also the same right, but not with the same advantage.

Facilitation of marriage, in English Ecclesiastical Law, is the boasting or giving out by a party that he or she is married to some other, whereby a common reputation of their matrimony may ensue.

Marriage Articles are an agreement between parties, a man and a woman contemplating marriage, intended as preliminary to a formal marriage settlement, to be drawn after marriage.

Marriage brokage, is the act by which a third person, for a consideration, negotiates a marriage between a man and a woman.

Marriage ceremony is the form, religious or civil, for the solemnization of a marriage between a man and a woman. If a couple is married in a civil ceremony, a judge or other authorized official performs this ceremony. During the days of long sea voyages, the captain of a ship was authorized to conduct a marriage ceremony while the ship was at sea.

In a religious ceremony, although different religious groups have their own versions, most catholic ceremonies take place during a mass, and the bride and groom receive Holy Communion, marriage is a Sacrament.

Marriage Consideration is the consideration furnished by an intended marriage of two persons, a man and a woman. It is the highest consideration known to the law.

Marriage License, is a license or permission granted by public authorizing two people, a man and a woman who intend to intermarry. By law it is made an essential prerequisite to the lawful solemnization of the marriage.

Marriage Notice Book is a book kept, in England, by the Registrar, in which applications for and issue of registrar’s licenses to marry are rewarded.

Marriage portion. Dowry; a sum of money or other property which is given to or settled on a woman on her marriage to a man.

Marriage promise. Betrothal; engagement to intermarry with another person of different sex.

Marriage Settlement, is a written agreement in the nature of conveyance, called a “settlement”, which is made in contemplation of a proposed marriage and in consideration thereof, either by the parties about to intermarry, one of them, or by a parent or relation on their behalf, by which the title to a certain property is settled, usually, to provide for the wife and children, etc.

Fleet Marriages. There were in the neighborhood of the Fleet prison about sixty marriage houses, some of which were public houses and others not. There is little doubt that many of marriages performed here had false dates, that people who were married here impersonated others, and that women who wished to plead a plea of coverture or hide their shame were married to men who, for a trifling gratuity, married any woman who would pay them, though they had previously married others.

Interracial Marriage is a marriage between people of different nationalities or different racial origins.

Morganatic Marriage was the lawful and inseparable conjunction of a man, of noble or illustrious birth, with a woman of inferior station, upon condition that neither the wife nor her children shall partake of the titles, arms, or dignity of the husband, or succeed to his inheritance, but be contended with a certain allowed rank assigned to them by the morganatic contract.

Plural Marriage in general is any bigamous or polygamous union, but particularly, a second or subsequent marriage of a man who already has one wife living, under the system of polygamy as practiced by mormons.

Scotch Marriage is a marriage contracted without any formal solemnization or religious ceremony, by the mere mutual agreement of the parties a man and a woman in the presence of witnesses, recognized as valid by the Scottish Law.

Marriage Act Royal was an act of 12 Geo. III, c. 1 (1772), by which members of the Royal family are forbidden to marry without the king’s consent, or except on certain onerous conditions.

Married Woman is a woman who has a husband living and not divorced.

Gay Marriage today is a material fact, ultra posse non potest esse, et vice versa. What is beyond possibility cannot exists, and the reverse; what cannot exist is not possible. Unconstitutional in the reuse that the gay marriage legislation, court made law conflicts with most recognized general principle. That is to say that is unwise, based upon a wrong and unsound principle, which conflicts with a generally accepted policy. It is material because it goes to the substantial matter in dispute and has a legitimate and bearing the decision of this issue; in the English Sense. In the American Sense, a fact, an action performed, an actual occurrence. A transgression because neither mode nor measure is preserved, for everyone in this act ought to have a mode and measure.
This is an act based on materialism. In the philosophic sense is based on the ideas that matter is the only thing in the universe that has reality, and that matters is the basis of all that exists. Materialism performs thinking that physical changes in the body and nervous system cause all mental processes. It’s justified by pointing out that people can really know only what they see, hear, smell, taste, or touch. This denies the existence of mind or soul as distinct from matter, and insists that feelings, and thoughts will have no independent existence.

Materialism has always been a popular philosophy among most scientists, because, if everything in the world is made of matter, then we can analyze and understand the world according to the laws which govern the way matter behaves, this idea is called scientific materialism. According to it, everything that exists now is the result of factors and conditions that existed before, and everything that will exist in the future must develop from some combination or change in the factors and conditions that exist now. This idea is often called mechanism.

Conclusion. Should we believe that the latest decisions of some States Courts of the United States on the gay marriage issue have helped bring about a decline at public decency in the country and departure of moral laws from our system? Should we obey moral laws to gain the approval of Society? It is the laws of conscience, amounting to those rules and principles of ethics which relate to right and wrong conduct and prescribe the standards to which in our world our actions should conform in our dealings with each other
We are compel to save society which in turn will save “the world will make you suffer. But be brave! I have defeated the world”.

Bastion against the poverty in the Americas and Caribbean

International Education Congress to Focus on Plans for Bilingual University

MIAMI
Educators and others from throughout the United States, Latin America and the Caribbean are being invited to attend the International Education Congress 2012, which will focus on plans for the creation of Continental’s first fully bilingual university, to be based in Puerto Rico.
Those attending the conference, scheduled for April in Miami, will also be discussing scholarships for students and professionals from Spanish-speaking countries.
“One of our key goals is to integrate the different educational systems of different countries pertaining to scientific, technical and humanistic issues into a system that will lend itself to education in the new policy against the poverty in the Americas and the Caribbean,” says Dr. Humphrey Humberto Pachecker, president of the National Association of Foreign Attorneys. NAFA, based in Miami, is organizing and sponsoring the international congress, known as Estudia 2012.
Pachecker says higher education authorities from throughout South America, Central America, the Caribbean and the United States are expected to participate in the congress and contribute the type of innovative ideas that will be necessary for the successful formation of the university.
“We hope that through the creation of a bilingual university and through scholarships we will be able to prepare students and professionals for work in today’s economy,” says Pachecker. “This will not only benefit them by improving their way of life and reducing the necessity for them to emigrate to the United States other parts of the world, but it will provide long-term benefits to their countries as well.”

Since the settlers there has been no more attractive land to reside and raise a family in the world than in this Country, the United States of America. There are no more brave people in the world than the Americans.

This Country’s enchantment is so powerful that people from all around the world gives up every possession, endure any pain, and even risk their lives just to arrive here. This is the only place on earth where a person may arrive with only the clothing wearing on it, with no education and be immediately enchanted with dreams of greatness and years later are able to tell its story of glory. The following is my story.
